The Collapse of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension sparked by the presentation of a new 28-article proposal for ending the war appeared – temporarily – to have been contained. A Washington representative spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its countermove: another massive barrage of missile and drone strikes on Kyiv.

The Pattern of Peace Talks and Military Action

The sequence of opposing developments captured the bleak nature of the outgoing year. By day, negotiation efforts are fought: optimistic declarations are released from multiple capitals. Immense energy is devoted on containing particular approaches. By night, the Kremlin clearly shows the world that, for them, war remains the primary tool for achieving "settlement".

Nocturnal Warfare

As Russia's attack progressed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was laid bare. Ukraine is capable of detecting missile launches from across the border, a capacity enabled by up-to-date information. From vantage locations, military aircraft that had been dispatched to counter approaching aerial threats streaked across the sky – sophisticated military planes supplied to Ukraine by European allies.

Soon thereafter, Kyiv's missile defense activated: multiple launches targeted at a Russian ballistic missile. This was a modern interception technology at work, most likely provided by allied countries. Every deployment jolts you unexpectedly, shaking the windows. The brief panic quickly transforms into sober acceptance: perhaps the incoming missile won't cause damage this time, protecting urban areas from ruin and further power outages.

Persistent Threats

Soon after, a large-caliber weapon engaged a aerial vehicle somewhere nearby, part of a mobile-fire group – almost certainly Western-made equipment. Unfortunately, the bullets missed the hostile drone – it continued its flight toward its target.

Periodically, this persisted until dawn. Kyiv faced the daybreak reports: seven people killed, damage and infrastructure problems in multiple buildings as a result of the night's assault. As customarily, everyone still went about their day – enduring hostilities. But those full day encapsulated Ukraine's critical military reliance on international aid – a need that neighboring countries are clearly incapable to replace in the short term.

Unsuccessful Negotiations

The comprehensive proposal from American leadership sparked intense emotion, controversy and deep concern – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have seen this script before, after earlier high-level meetings and bilateral conferences.

Every new approach from Washington adheres to the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, effectively counters. They manage the tension but never actually win the battle. This cycle will, undoubtedly, persist.

Political Considerations

It is convenient to criticize specific actors of persistently promoting Moscow's conditions. But that does not seem to be the complete picture. US administration works based on a principle understood by international relations experts: you cannot win at the negotiating table what you have lost on the battlefield. The US administration believes that it is impossible to compel Moscow to abandon the areas that it presently holds in Ukraine's occupied territories.

The problem is that while accepting these circumstances, American administration does little to prevent Kremlin actions, through diplomacy or military means, from thinking that the situation will not evolve additionally in its advantage in the months ahead.

Conflicting Perspectives

Therefore, Moscow is convinced that the clock favors them – that Ukraine and its partners are coming close to fatigue. Their incentive to sign a deal that does not give them the maximum possible gain is close to zero. There may be numerous efforts to stop fighting, but they will continue as long as Russia's government remains highly assured in the conclusion.

On the contrary, Kyiv believes that Ukraine can still persist, progressively conceding people and territory but avoiding a complete military breakdown until circumstances change in its advantage.

Present Conditions

Factually, there are no actual prerequisites for a ceasefire. Now, subjective factors are entering the equation: personal goals to broker a ceasefire and achieve global acclaim, and Kyiv's dual difficulties – on one hand, not to distance important partners, and on the other, to unite the population around the flag against any plan Kyiv finds unsuitable, so that their focus does not switch to internal issues. And although their task will now be considerably more difficult after latest incidents, it remains very improbable that this will alter their fundamental strategy.

These opposing factors are influencing discussions.

Assessment and Future

It took a just a single week to kill the proposed articles of the most recent proposal. Forceful and unpredictable management of the matter by American leadership, pushback by Ukraine and the remaining European nations, along with calming attempts of diplomats, and finally, current information leaks, all achieved their purpose.

While new initiatives based on previous concepts are forthcoming, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to counter political attacks from Washington that are based on Russian demands and show certain reluctance to alter the situation, if they stand together and improve their protective measures at a much faster pace. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the coming months, primarily depend on sustained allied backing.
